- This must be a first offense OWI
- You do not have a prior license revocation or suspension in the last 12 years
- You are willing to install an ignition interlock device
If you meet these criteria, you can apply for a temporary restricted license soon after being convicted. As the name implies, this allows you to drive but restricts your activity. If you are not driving for a “good” reason, then you shouldn’t be driving. Generally, this means only getting behind the wheel to get to work, take care of your kids, or to travel to mandated community service or courses the court has ordered.
How Long Can My License Be Taken Away After an OWI?
If you are wondering when you’ll get your full driving privileges back, that can depend on the exact nature of your conviction. The most important factors are how many OWI convictions you have and whether or not you refused a chemical test.
For a first offense, expect to lose your license for up to 180 days. Refusing a test can bump that up to a year.
If this is your second offense within 12 years, a suspension could last as long as a year if you agree to a breathalyzer. Refuse the test and your suspension could last two years.
A third offense can result in your license being revoked for up to six years. Even if you are acquitted, refusing the chemical test can lead to a suspension of two years.
What Do I Have to Do to Get My License Back?
If you cannot apply for a temporary restricted license, then you just have to wait out your suspension period. During this period, you should:
- Pay your civil penalty of $200
- Complete any court-ordered classes or treatment
- Have proof of SR-22 insurance
- Install ignition interlock devices in all vehicles if court-ordered
