The firm’s client, who was originally charged with multiple serious offenses and faced the possibility of spending the rest of his life in prison, has successfully resolved his case with a plea deal resulting in time-served.
The client was initially charged with a Felony C (possession with intent), a Felony D (tax stamp violation), and a serious misdemeanor (possession). Both felony charges were subject to enhancement under the habitual offender statute, which increased the potential punishment to 15 years of incarceration per felony, with a mandatory minimum of three years for each. In addition, the Felony C charge was further enhanced under a separate statute, tripling the maximum potential sentence.
Altogether, the client was facing a staggering maximum sentence of 61 years in prison, with a mandatory six years of incarceration before becoming eligible for parole if all sentences were to be served consecutively.
However, thanks to the tenacious advocacy of Jacob Heard, Esq., Iowa Defenders, PLLC was able to negotiate a plea agreement that dramatically reduced the charges and penalties. The client ultimately pled to one aggravated misdemeanor, with a sentence of time-served—amounting to just 205 days in jail.
Although the client remains in custody due to a federal hold, his Iowa case is now concluded, and he has avoided the severe penalties originally sought by the prosecution.
