It is a great honor that we announce that Jacob Heard, Esq., of Iowa Defenders, PLLC, just got a motion to suppress granted in a recent Dallas County case. Here, Jacob’s client was being tried for four Felony D charges, after the vehicle he was a passenger in was stopped by police.
Specifically, the Dallas County court found that the police officer violated his client’s constitutional right (i.e., Fourth Amendmant right) against an unreasonable search and seizure. This was due to the fact that the officer prolonged the stop without any reasonable cause, but rather as a delay tactic to give the K-9 officer more time to arrive on the scene and conduct an open-air sniff. Ultimately, the court dismissed all four Felony D charges, with court costs going to the state.
