Drug possession charges can lead to big fines and long prison sentences. What you do after you get arrested matters. It could make the difference between a harsh punishment and a case that gets dismissed. Our Dallas County drug lawyers can help you stand up for your rights and protect yourself once you have been accused of a crime.
Can Cops Search My Home or Vehicle If I’m Accused of Drug Possession?
Cops can search your home or vehicle if they have a warrant. This means that they went to a judge, presented evidence, and made their case. If the judge believes that they have valid cause for carrying out a search, they can.
Sometimes the police won’t have enough evidence to get a warrant, so they will ask for your consent to search. Maybe you have nothing to hide and you think that there is no harm in letting them search. We do not recommend this. Even if you think that there is zero chance of them turning up evidence against you, there is no good reason to let them perform a search.
What Are the Punishments for Drug Possession?
Punishments for drug possession are often quite harsh and a conviction is almost certain to mean jail time and a fine. How many offenses you have can also make a big difference, so if you have previously been convicted for drug possession you need to be extra careful here. As an example, a first offense for marijuana possession can be punished with six months of jail time, but a second offense can be punished with a year-long prison sentence.
Penalties for possessing other drugs, including controlled substances like heroin and cocaine, are likely to be even more severe. You can also face felony charges if you are accused of possessing enough of a drug to distribute it and sell it to others.
Should I Talk to the Police?
The cops might tell you that cooperating with them will make this process go smoothly. If you have nothing to hide, why won’t you consent to a search? Why won’t you tell them where you were at a specific time? The bottom line is that you have the right to remain silent so that you don’t incriminate yourself.
When the cops question you, ask for your attorney. There is no good reason to talk to them without one. Your lawyer can tell you what you should say and communicate with the authorities on your behalf.
